Title IX 101 provides an overview of the evolution of Title IX since its inception to present day. This course is recommended for anyone new to Title IX and for anyone wanting a foundation on the changes to Title IX brought about by the new regulations. Certified Title IX Investigator Level 1

This Level 1 course provides Title IX Investigators with the training required under the Title IX regulations and VAWA/Clery including the definition of sexual harassment and education program/activity and serving impartially in the role. Certified Title IX Decision Maker Level 1

Title IX Decision Maker is a Level 1 course designed to provide training pursuant to the Title IX regulations and VAWA/Clery including the definition of sexual harassment and education program/activity and serving impartially in the role. It is appropriate forTitle IX hearing chairs, Title IX hearing panel members, Title IX appellate administrators and other decision makers in matters alleging sexual harassment. The course includes an overview of Title IX and litigation trends that support panel hearings and how Title IX hearings are different than other conduct hearings on campus, a review of special considerations for Title IX complainants and Title IX respondents, the role of Title IX Advisors in the process, how to conduct assessments of credibility and relevance, cross examination, burdens of proof, weighing direct and circumstantial evidence, and much more. Title IX Advisor

The new Title IX regulations provide that a complainant and respondent are entitled to a University/School District provided Title IX advisor, without fee or charge, in a live hearing in order to conduct cross-examination. Although the regulations do not require Title IX training for advisors, training is highly recommended on their role and function. This course includes the roles of all University administrators in a Title IX process, an overview of Title IX investigations and Title IX hearings under the new regulations, and specific considerations on the role of the Title IX advisor.

Title IX Informal Resolution Facilitator

The new Title IX regulations allow for informal resolution in sexual misconduct matters and also require training for Informal Title IX Resolution Facilitators. This course includes the required Title IX training on the Title IX definition of sexual harassment, the scope of an institution’s education program or activity according to Title IX, how to conduct an informal resolution process and the different types of informal Title IX resolution process that may be considered, and how to fulfill the role of Title IX Informal Resolution Facilitator and serve impartially, including avoiding prejudgment to the facts at issue, conflicts of interest, or bias. Title IX Athletics

Title IX compliance is mutli-faceted and includes a school district’s response to reports of sexual harassment and gender-equity in athletics. Title IX Compliance for athletics addresses the important role athletics plays in both of these areas. With respect to sexual harassment, the course provides an overview of the new Title IX regulations, the definition of sexual harassment and when it occurs within the school’s program or activity, and the vital role athletics plays in the prevention of sexual harassment – including the intersection of bullying, hazing and sexual harassment. The course also discusses evaluating gender-equity in athletics utilizing OCR’s three-part test. Finally, the course provides a brief discussion of litigation trends with transgender students and student-athletes in access to facilities and in competition.
