The role of the Title IX Investigator has become more complex with the new Title IX regulations. Annual training will assist investigators in staying current with industry standard as well as any changes in the law or guidance. ICS’ 2021 Refresher and Update Training provides Title IX Investigators with the following critical information to assist them in their role:

  1. Refresher: This portion of the training will be a refresher of mandated materials under the new Title IX regulations released in 2020. It will include the definition of sexual harassment, when it falls within an institution’s program or activity, the formal Title IX grievance process as a whole and specific to the role of an investigator in the process, conflicts of interests and bias. As always, updated Compliance Aids that correspond to these concepts are included such as templates, checklists, and flow charts. The refresher will provide an in-depth review of Title IX investigations from real-world experiences and lessons learned this past year.
  2. Update: The Title IX landscape continues to evolve due to case law developments and changes in Office for Civil Rights guidance anticipated under President Biden. This portion of the training will provide attendees with comprehensive, up-to-date, information inclusive of all changes that have developed to date. Training also includes a discussion of an institution’s requirements under Clery/VAWA and its interplay with the new Title IX regulations. This discussion will also include resolutions regarding matters involving non-Title IX sexual misconduct as well as sex- and gender-based harassment and it will discuss the interplay of civil rights investigations and Title IX investigations on campus.
  3. Implementation: A signature of ICS training is hypotheticals to assist attendees in putting concepts into practice. A portion of training is dedicated to implementation strategies for investigators including the two 10-day required review periods, report writing and evaluating relevant evidence, and participation in live hearings or resolutions.
