Notice of Proposed Rulemaking Reaches Final Step Before Publication

On February 17, 2022, the proposed Title IX regulations were submitted for a final agency review before publication. The Department of Education announced that the new Title IX rule had been formally submitted to the Office of Information and Regulatory Affairs, where OIRA will review the proposed rule for potential costs and benefits. According to OIRA, this review period is limited to no more than 90 days unless an extension is granted.
This is a major sign that new Title IX regulations continue to make their way through the rulemaking process. Once OIRA’s review is complete, the Notice of Proposed Rulemaking will be published in the Federal Register for a public review and comment period. Based on this information, we estimate the NPRM is still on track to be released to the public in April/ May 2022.
