Putting Policy Into Practice Webinar Series

In response to the challenges presented under the new Title IX regulations, we have developed a four-part webinar series called Putting Policy into Practice. After a semester of working under these regulations, the ICS team is experiencing the challenges of these complicated processes alongside you. We are learning where the roadblocks are occurring from our clients and trainees as well as firsthand through our service as external investigators, advisors, and decision-makers. This series will walk you through some of the most complicated expectations under the new regs. It will also provide practical implementation guidance and suggestions for Title IX team development. The series will wrap up with an entire session devoted to hypothetical situations, scenarios, and case studies. This will be a hands-on cohort style experience for all participants. This series is appropriate for Title IX Coordinators, Deputy Title IX Coordinators, and other Title IX key officials. Course Level: Mid to advanced. Course Prerequisite: Level 1 ICS training and/or 2+ years of Title IX experience. Each session is one hour of content and a half hour of Q&A.

February 4th: Implementation of the New Regulations and Smooth Transitions
This webinar will cover ways to facilitate smooth transitions in your Title IX process under the new regulations, starting with the report of Sexual Harassment, through Formal Complaint and grievance process. You will be provided with unique considerations related to working with Complainants and Respondents through this process. It will also discuss lessons learned, on the ground, “living the regs” in this process. The webinar is one hour with a 30 minute Q&A. The first portion is recorded.
February 11: Emergency Removals
The new Title IX regulations provide for emergency removals of a Respondent if an individualized safety and risk analysis determines that an immediate threat to the physical health or safety of any student or other individual arising from the allegations of Sexual Harassment justifies removal. This webinar will explore when emergency removals are appropriate, the intersection of your Title IX office and Behavior Intervention/Threat Assessment Team, and unique considerations when contemplating removal of student respondents vs. employee respondents. The webinar is one hour with a 30 minute Q&A. The first portion is recorded.
February 18th: Live Hearings
The requirements for a live hearing with “cross examination” to determine responsibility and sanction is one of the biggest changes for most institutions under the new regulations. This webinar will be a deeper dive into live hearings, pre-hearing conferences, including hearing structure, virtual hearing benefits and challenges, questioning witnesses and making relevancy determinations. The webinar is one hour with a 30 minute Q&A. The first portion is recorded.
February 25th: Hypos!
Hypos! This webinar will be entirely focused on putting concepts into practice through numerous hypotheticals exploring the various challenges under the new regulations and lessons learned “living the regs.”

Training for Title IX decision makers is critical and now mandatory under the new Title IX regulations issued on May 6th. This virtual training is not a webinar, but instead a “live” and interactive experience. The sessions will include an overview of the Title IX and the new regulations, the definition of sexual harassment and the scope of program/activity, how to serve impartially in the role, the role of advisors in the process, the live hearing requirement, how to conduct relevancy assessments, burdens of proof and more. This training will incorporate hypotheticals to put the training information into practice and compliance aids. Appellate decision-makers in the Title IX grievance process must be trained under the new regulations, whether they are reviewing dismissals of Formal Complaints or Determinations. The sessions will include the definitions of sexual harassment and program/activity, how to serve impartially in the role, the general Title IX process as prescribed under the new regulations, grounds for appeal under the new regulations, what constitutes the “record” and a review of an appeal, and more. Report writing can be challenging, even for the most seasoned Title IX Investigators. Join Courtney and Betsy for this interactive virtual training focused on honing report writing skills for investigations under the new regulations. Attendees will participate in a 4 hour live session with an emphasis on evaluating information, sharing the evidence directly related to the allegations, fairly summarizing relevant evidence, and completing investigative reports in a timely and equitable manner. Virtual Certified Title IX Advisor Training, Level 1

The new Title IX regulations provide that a complainant and respondent are entitled to a University/School District provided advisor, without fee or charge, in a live hearing in order to conduct cross-examination. Although the regulations do not require training for advisors, training is highly recommended on their role and function. This virtual training is not a webinar, but instead a “live” and interactive experience. It will include the roles of all University administrators in a Title IX process, an overview of Title IX investigations and hearings under the new regulations, and specific considerations on the role of the advisor. Participants will work through case studies to put the concepts learned into practice and also receive compliance aids. Space is limited to foster an interactive learning environment. Virtual Certified Title IX Advisor Training, Level 2

The most anticipated role of an advisor under the new Title IX regulations is during the live hearing where advisors ask questions of the other parties and witnesses through “cross-examination.” This Level 2 training will provide a deep dive into the live hearing process, appropriate questioning and questions of parties and witnesses, relevancy considerations in “cross” and unique circumstances that may arise in the role when a party does not participate in the hearing. The training will include examples of questions that may be deemed irrelevant by a decision maker. Although the regulations do not require training for advisors, training is highly recommended. Prerequisites for this course is Title IX Advisor Training – Level 1, a prior ICS Virtual training under the new regulations or prior experience as an advisor (however, that is only upon petition to ICS for approval). Attendees will receive training that complies with the new Title IX regulations, addresses best practices based on current litigation trends and court decisions, and covers any other necessary material based on any new OCR guidance or actions under the Biden administration. 


Virtual Certified Informal Resolution Facilitator Training, Level 1

Date: March 10, 1 PM – 3 PM EST

The new Title IX regulations allow for informal resolution in sexual misconduct matters and also require training for Informal Resolution Facilitators. This virtual training is not a webinar, but instead a “live” and interactive experience. It will include the required training on the definition of sexual harassment, the scope of an institution’s education program or activity, how to conduct an informal resolution process and the different types of informal resolutions that may be considered, and how to fulfill the role and serve impartially, including avoiding prejudgment to the facts at issue, conflicts of interest, or bias. The training will also discuss the Title IX process under the new regulations and the facilitator’s role in that process. Participants will work through case studies to put the concepts learned into practice and also receive compliance aids. Space is limited to foster an interactive learning environment.
