Tuesday Takeaway: Title IX, Title VI, and Title VII Headlines We Are Not Ignoring This Week

Everyone in this space already knows that federal enforcement activity is quickly shifting. Scrutiny has been heightened for weeks, and expectations are still in place amid all of the legal uncertainty. This week, we are breaking down some of the big headlines in compliance.

What Do the Recent OCR Workforce Reinstatements Mean?

According to a recent status report filed by OCR in the Victim Rights Law Center litigation, 85 OCR employees have been reinstated since September 8, with an additional ~60 scheduled for reinstatement this week. While these positions could be temporary depending on court outcomes, OCR now has expanded capacity… and they may use it.

Tuesday Takeaway: Whether or not the reinstatements are long-lived, compliance teams should operate as if enforcement volume will increase.

Prioritize internal Title IX and civil rights reviews before inquiries resume. Waiting for definitive legal clarity could mean falling behind peers who have already prepared.

Minnesota Title IX Sports and Facilities Finding

The ED and HHS issued a joint finding that the Minnesota Department of Education and Minnesota State High School League violated Title IX by allowing male participation on girls’ teams and access to female facilities.

Federal agencies clarified that schools must reconcile participation and facility policies with Title IX interpretations at the federal level, even where state guidance differs. Districts and athletic associations should expect increased scrutiny of policies related to sex separation.

Tuesday Takeaway: Review frameworks now rather than waiting for an investigation triggered by a community challenge or federal monitoring.

DOJ Investigates Des Moines Public Schools Over Race-Based Hiring Practices

The DOJ opened a Title VII investigation into alleged race-based employment criteria in teacher hiring practices at Iowa’s largest district. In this instance, the DOJ states that employment diversity initiatives may cross into enforcement territory if tied to protected traits.

Tuesday Takeaway: It is time to evaluate hiring goals, fellowship criteria, and recruitment programs at both higher ed institutions and K-12 districts and schools. Hiring should be framed around opportunity access and not demographic outcomes. Well-intended efforts may still trigger Title VII exposure.

HHS Moves to Suspend or Debar Harvard Over Title VI Allegations

>HHS OCR referred Harvard for possible suspension or debarment tied to allegations involving antisemitism response failures. This move could cut off federal grants or contracts. To date, this is one of the most obvious examples that enforcement is moving beyond corrective agreements into funding consequences. We discussed this topic at length in last week’s Tuesday Takeaways.

Tuesday Takeaway: Institutions with federal grant dependencies, particularly those that are research-heavy campuses, should treat Title VI compliance as a funding safeguard, not just a policy requirement. Suspension and debarment leverage is likely to expand.

NCAA Transgender Participation Mostly Dismissed but Title IX Claim Advances

A federal judge has dismissed most claims in a lawsuit filed by former Kentucky swimmer Riley Gaines and other athletes against the NCAA. The lawsuit challenged the NCAA’s policy allowing transgender women to compete in women’s sports, alleging violations of Title IX. While the majority of the claims were dismissed, the central Title IX claim that the NCAA’s participation policy may violate Title IX was allowed to proceed.

Even when institutional liability is not directly on the line, governing bodies’ policies may still shape Title IX interpretations.

Tuesday Takeaway: Athletics compliance teams should monitor this case closely. Depending on how it develops, institutions may face pressure to align with either federal interpretation or governing-association policy, even where the two diverge.
