The new academic year is starting for many of you, and there has been constant development in the Title IX space over the summer. Specifically, there have been cuts to the Department of Education (ED) and Office for Civil Rights, litigation challenges, Supreme Court rulings, and paused funding. If you are wondering what that means for Title IX and whether your institution or district still needs to invest in compliance, I want to speak to that directly.
Here is the truth: even with a reduced federal role, your responsibilities under Title IX do not go away.
- Legal liability still exists. Courts have made it clear that schools, districts, and institutions have a duty to prevent and respond to sexual harassment. That does not change based on the administration or changes within the ED.
- The 2020 Title IX Regulations are still in effect. The 2020 Title IX regulations remain in effect. These regulations mandate training for your Title IX team, and they have very prescriptive requirements for the Formal Title IX grievance process.
- State laws are still in play. Many states have their own civil rights mandates, and some are even more expansive than Title IX. These remain enforceable and critical.
- Your reputation is on the line. In a world of viral headlines and increased litigation, having a clear, fair, and equitable process is not optional; it is essential.
